Terms of Service

1. Acceptance of Terms

Welcome to Encue. These Terms of Service (“Terms”) govern your use of the Encue mobile application and the website at encue.app (together, the “Service”), operated by Encue (“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of the Service

Encue helps you discover where movies and TV shows are available to stream across different platforms, track watchlists, rate and review titles, and connect socially with friends. Encue does not host, stream, or provide any video content, and is not a streaming service. We point you toward official third-party streaming services where content may be available.

3. No Affiliation with Streaming Services

Encue is not affiliated with, endorsed by, or sponsored by any streaming service, studio, network, or content provider. All trademarks, titles, logos, and brand names are the property of their respective owners and are used for identification purposes only (nominative fair use).

4. Eligibility and Accounts

You must be old enough to form a binding contract and meet the minimum age required in your jurisdiction to use the Service. You may create an account using Sign in with Apple. You are responsible for the activity under your account and for keeping your access secure. You agree to provide accurate information and to keep it up to date.

5. User Content

The Service lets you create content such as reviews, ratings, lists, recommendations, and profile information (“User Content”). You retain ownership of your User Content. You grant Encue a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute your User Content within the Service for the purpose of operating and providing the Service. You are responsible for your User Content and represent that you have the right to post it. You agree not to post content that is unlawful, infringing, defamatory, harassing, hateful, obscene, or that violates the rights of others. We may remove User Content that violates these Terms or that we reasonably believe is harmful or unlawful.

6. Community Standards and Moderation

Encue is a community. We have zero tolerance for objectionable content or abusive users. Objectionable content includes harassment, hate speech, threats, sexually explicit material, spam, and impersonation.

• The app provides tools to report content or users and to block users. Blocking removes all interaction between you and the blocked user, in both directions.
• We review reports promptly, generally within 24 hours, and will remove violating content and/or suspend or terminate the accounts responsible.
• To report anything you cannot report in-app, email support@encue.app.

7. Acceptable Use

You agree not to: use the Service for any unlawful purpose; scrape, harvest, or copy data from the Service except as expressly permitted; attempt to disrupt, reverse engineer, or compromise the Service or its security; circumvent regional or platform restrictions, or misuse third-party links; impersonate others or misrepresent your affiliation; or use the Service to harass, abuse, or harm other users.

8. Affiliate Links and Commissions

The Service may contain affiliate links to streaming services. If you subscribe through such a link, we may earn a commission at no additional cost to you. We are not responsible for the products, services, pricing, or policies of those third-party streaming services.

9. Third-Party Services and Content Data

Streaming availability and title information are provided by third parties, including The Movie Database (TMDB), and may be inaccurate, incomplete, or out of date. Always confirm availability, pricing, and details directly with the official streaming service. The Service may link to third-party websites and apps that we do not control, and we are not responsible for their content, policies, or practices. This product uses the TMDB API but is not endorsed or certified by TMDB.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any availability information is accurate.

11. Limitation of Liability

To the fullest extent permitted by law, Encue and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful. You may stop using the Service and request account deletion at any time.

13. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, provide additional notice. Continued use of the Service after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws principles.
